Esma act
On March 10, 2023, the Union Government of India invoked the Essential Commodities Act in response to ongoing geopolitical disruptions affecting fuel supplies, particularly liquefied petroleum gas (LPG). This decision was made to ensure an uninterrupted supply of domestic cooking gas, which has become increasingly critical in light of the West Asia Conflict impacting fuel availability.
Government Directives
Following the invocation of the ESMA Act, the Ministry of Petroleum and Natural Gas issued directives to oil refineries and petrochemical units, mandating them to maximize LPG production specifically for domestic use. The government emphasized the need for energy security, prioritizing the supply of LPG to households.
Refineries were instructed to reduce gas allocation to oil refining companies to approximately sixty-five percent of their past six-month gas consumption. In contrast, fertilizer plants were required to ensure that they maintain seventy percent of their average gas consumption over the same period. This strategic allocation aims to balance the needs of various sectors while ensuring that domestic consumers are prioritized.
Supply Management Measures
To further manage the supply chain, gas marketing entities were ordered to maintain eighty percent gas supply to tea industries and other industrial consumers. Additionally, City Gas Distribution entities were tasked with ensuring eighty percent gas supply to industrial and commercial consumers.
A 25-day inter-booking period was introduced to prevent hoarding and black marketing of LPG. This measure is designed to regulate the availability and equitable distribution of petroleum products and natural gas across the country.
Current State
As of now, the government is actively monitoring the situation to ensure compliance with these directives. Every producer, importer, transporter, marketer, or distributor of natural gas is required to furnish information to the Central Government, facilitating better oversight of the supply chain.
Importance of the ESMA Act Invocation
The invocation of the ESMA Act is significant as it underscores the government’s commitment to maintaining energy security amid external pressures. The measures taken aim to stabilize the domestic LPG market and ensure that households have access to essential cooking gas during a time of uncertainty.
In light of current geopolitical disruptions to fuel supply and constraints on the supply of LPG, the Ministry of Petroleum and Natural Gas has reiterated the importance of these actions. The focus remains on ensuring that the additional production of LPG is directed towards meeting domestic needs, thereby safeguarding the interests of consumers across India.
